Another defamation matter resolved recently by the look of things .... ouch.

Received recently in our correspondence - this ran on the Daily Telegraph web (but not newsprint?) earlier this week. We were going to blog/amplify it but wanted to check library press print copies. Didn't see it in Wednesday edition (?):

"TANIA EVERS - CORRECTION AND APOLOGY
From: The Daily Telegraph
February 09, 2010 4:24PM

[happy picture of human rights, criminal law veteran barrister Tania Evers]

Tania Evers Source: The Daily Telegraph

ON 16 April 2008, The Daily Telegraph published an article about the conduct of Tania Evers as defence counsel in a criminal trial. There was also an editorial on the issue. Various criticisms were made of Ms Evers.

The Daily Telegraph acknowledges that criticisms made of Ms Evers were unjustified and that some of the facts asserted were incorrect.

In particular, the Daily Telegraph accepts that Ms Evers was not warned by the trial judge about her conduct, and accepts that there was nothing wrong with her conduct.

The Daily Telegraph withdraws all criticism made of Ms Evers and unreservedly apologies to her."

This story strikes at the heart of so much that is wrong with the legal system. If you've got the money, why not pour it into an irrelevant trial and issue. The solicitors and barristers (at least those on the losing side) should have costs orders made against them to discourage the taking of cases like this.
